1. Agreement to these terms

These Terms & Conditions form a binding agreement between you and DigMusEd (Digital Music Education) ("DigMusEd", "we", "us") governing your access to https://www.digmused.com and all related services, including examinations, remote proctoring, the candidate portal, the concert video store and orchestra programmes.

By accessing the site, creating an account, booking an exam or making a purchase you confirm that you have read, understood and accept these terms and our Privacy Policy. If you do not accept them, you must not use the services.

Where a candidate is under 18, a parent, guardian, teacher or school accepts these terms on their behalf and remains responsible for their compliance.

2. Accounts and eligibility

• You must provide accurate, current and complete information and keep it up to date. Misrepresentation of identity, age, grade or eligibility may void an entry without refund.
• Accounts are personal. You are responsible for keeping your password confidential and for all activity carried out under your account.
• Staff, examiner and exam board accounts are created only by DigMusEd. Public self-registration for administrative accounts is not available.
• We may suspend or terminate any account that breaches these terms, compromises examination integrity or poses a security risk.

3. Examination entries, fees and refunds

• An entry is confirmed only when the applicable fee has been received in full, or a valid 100% discount code has been applied, and the entry has been approved by DigMusEd.
• Fees are quoted inclusive of applicable taxes unless stated otherwise, and are non-transferable and non-refundable except at our sole discretion.
• Candidates must select an exam month at entry. The submission deadline is 28 days from the first day of that month. Late or missing submissions are recorded as an absence with no refund.
• We may reschedule or cancel a session for operational, technical or force-majeure reasons; in that event we will offer a rescheduled session or, at our discretion, a credit or refund of the fee paid. This is your sole remedy.

4. Conduct during examinations and proctoring

• You consent to identity verification, webcam and screen monitoring, environment scanning and audio monitoring for the duration of a remotely proctored exam, and to the retention of the resulting evidence as described in the Privacy Policy.
• Only permitted materials and one exam device may be present. Additional phones, second screens, notes, other persons in the room, communication with third parties, use of AI tools and any impersonation are prohibited.
• Recordings must be single, unedited takes in which the candidate is clearly visible and states their full name and unique exam number at the start.
• Malpractice — including plagiarism, collusion, impersonation, use of prohibited materials or tampering with the proctoring software — may result in disqualification, annulment of results, withdrawal of certificates, a bar on future entries and referral to your school, employer or the authorities.
• Automated integrity flags are always reviewed by a human before any sanction is imposed. You may appeal a decision under section 5.

5. Results and certificates

• Results are issued as Distinction, Merit, Pass or Below Pass in accordance with the published rubric. Marking is carried out by qualified examiners and moderated internally.
• Examiners' academic judgement is final. Appeals may challenge procedure, administration or arithmetic, not the exercise of academic judgement.
• Queries and appeals must be submitted in writing within 14 days of the publication of results, together with any fee published for a remark.
• Certificates remain our property; we may withdraw or reissue a certificate obtained through error, misrepresentation or malpractice.

6. Concert store, digital content and orchestra

• Purchases of concert videos and all-access passes grant a personal, non-exclusive, non-transferable, revocable licence to stream the content for personal, non-commercial viewing on this site only.
• You may not download, record, copy, re-broadcast, publicly perform, share credentials for, or circumvent any technical protection applied to the content. Breach terminates the licence immediately without refund.
• Where a purchased title is not yet available, you join a waiting list and will be notified by email when the full video is published; this is not a defect and does not entitle you to a refund.
• The right to cancel digital content ends once streaming has begun; by purchasing you agree to immediate performance.
• Orchestra registration is an expression of interest only. Submission does not guarantee a place; selection follows audition and is at our sole discretion.

7. Intellectual property

All content on the site — syllabuses, question papers, rubrics, recordings, photographs, text, graphics, logos, software and the DigMusEd name and marks — is owned by or licensed to DigMusEd and protected by the Copyright Act and other laws. You may not copy, adapt, distribute, publish, scrape, train machine-learning models on, or create derivative works from any part of it without our prior written consent.

You retain ownership of the performance recordings and materials you submit, and grant DigMusEd a worldwide, royalty-free licence to store, reproduce and process them for assessment, moderation, verification, quality assurance, dispute resolution and regulatory purposes.

8. Acceptable use

• Do not attempt to gain unauthorised access to any account, server, database or storage area, or probe, scan or test the vulnerability of the platform.
• Do not upload malware, unlawful, defamatory, obscene or infringing material, or content that violates another person's privacy.
• Do not use bots, scrapers or automated means to access the services, or resell or commercially exploit any part of them.
• Do not interfere with the operation of the platform or with other users' use of it.

9. Payments and chargebacks

Payments are processed by third-party providers subject to their own terms. You warrant that you are authorised to use the payment method. Fraudulent transactions and unjustified chargebacks may result in suspension of access, annulment of entries and recovery of costs.

10. Third-party links and services

The site may link to or integrate third-party services. We do not control and are not responsible for their content, availability, security or practices, and any dealings with them are at your own risk.

11. Availability and no warranty

The services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law we exclude all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, or that any particular result, grade, placement or outcome will be achieved.

You are responsible for your own device, camera, microphone, power supply and internet connection. Failures on your side during an examination are not our responsibility.

12. Limitation of liability

To the maximum extent permitted by Nigerian law, DigMusEd, its owners, directors, officers, employees, examiners and partners shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for loss of profit, opportunity, data, reputation, academic standing or anticipated savings, however arising.

Our total aggregate liability arising out of or in connection with the services, whether in contract, tort (including negligence), statute or otherwise, is limited to the total amount you paid to DigMusEd in respect of the specific service giving rise to the claim in the 12 months preceding the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify, defend and hold harmless DigMusEd, its owners, directors, officers, employees, examiners, contractors and partners from and against all claims, demands, regulatory penalties, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or connected with your use of the services, your breach of these terms or of any law, your infringement of third-party rights, any content or recording you submit, any examination malpractice, or any misuse of an account issued to you.

14. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including power or internet failure, network or hosting outage, cyber-attack, strike, civil unrest, epidemic, government action, fire or natural disaster.

15. Suspension and termination

We may suspend or terminate your access immediately, without refund, where we reasonably believe you have breached these terms, engaged in malpractice or created a security or legal risk. Sections concerning intellectual property, indemnity, limitation of liability and governing law survive termination.

16. Governing law and dispute resolution

These terms are governed by the laws of the Federal Republic of Nigeria. The parties will first attempt to resolve any dispute amicably within 30 days of written notice. Failing that, the dispute shall be referred to arbitration in Lagos, Nigeria under the Arbitration and Mediation Act 2023 before a single arbitrator, in English, and the award shall be final and binding. Nothing prevents either party from seeking urgent injunctive relief from the courts of Nigeria, which otherwise have exclusive jurisdiction.

17. General

• These terms, together with the Privacy Policy and any exam-specific rules, constitute the entire agreement between us.
• If any provision is held unenforceable, the remainder continues in full force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign your rights; we may assign ours on notice as part of a reorganisation or transfer of business.
• We may amend these terms; the current version and effective date appear on this page. Effective 5 August 2026. Continued use after a change constitutes acceptance.
